1. Acceptance of Terms

These Terms and Conditions (“Terms”) govern your use of https://hibachi2u.com, booking of Hibachi2U services, purchase of products, submission of content, and interaction with Hibachi2U LLC (“Hibachi2U,” “we,” “our,” or “us”). By accessing the website, submitting a booking, making a payment, attending an event, or otherwise using our services, you agree to these Terms.

2. Services

Hibachi2U provides a mobile hibachi-at-home experience, including a chef, hibachi grill, food, and entertainment for private parties and events, subject to availability and service area limitations. Service details, menu items, pricing, guest minimums, add-ons, travel fees, and booking availability may vary by location and event.

3. Outdoor-Only Cooking

Hibachi2U cooks outside only. We do not cook inside homes, garages, enclosed indoor premises, or other unsafe spaces. Customers may host guests indoors, but the chef, grill, and cooking station must be outdoors in an area approved by the chef and suitable for safe cooking.

The customer must provide a safe, level, accessible, and dry outdoor cooking area, including adequate cover in the event of rain or other weather. Hibachi2U may refuse, pause, modify, or stop service if conditions are unsafe, inaccessible, unlawful, or unsuitable for cooking.

4. Customer Responsibilities

Unless Hibachi2U agrees otherwise in writing, the customer is responsible for:

• Providing tables, chairs, plates, utensils, and guest setup items.

• Providing a safe outdoor cooking area with adequate space, ventilation, lighting, and access.

• Providing rain cover or other weather protection for the chef and cooking station when needed.

• Ensuring the event location allows outdoor cooking, open-flame cooking, mobile catering, or similar services.

• Obtaining any required permissions, HOA approvals, venue approvals, property owner approvals, permits, or authorizations.

• Providing accurate event address, guest count, timing, allergy information, menu selections, and contact information.

• Ensuring guests, pets, children, furniture, decorations, and other items remain a safe distance from the grill and cooking station.

• Complying with all reasonable instructions from the chef or Hibachi2U staff for safety and service flow.

5. Booking, Pricing, and Payment

Pricing, minimums, travel fees, upgraded proteins, add-ons, administrative fees, and payment terms are provided through the website, booking process, invoice, or other Hibachi2U communication. Published prices are subject to change before booking confirmation.

The customer agrees to pay all amounts associated with the booking. Credit card payments, administrative fees, convenience fees, processing-related fees, or similar charges may apply where permitted by law and will be disclosed as applicable. If payment by credit card is required before the event, the customer must complete payment by the stated deadline.

6. Guest Counts, Minimums, Menu Items, and Food Allergies

The customer must provide accurate guest counts and menu selections. Hibachi2U may require minimum spend amounts for all parties. Changes to guest count, menu selections, add-ons, or upgraded proteins may affect pricing and availability.

Customers must notify Hibachi2U of allergies, dietary restrictions, gluten-free needs, vegan or vegetarian needs, and other food concerns before the event. While Hibachi2U may attempt to accommodate certain requests, we cannot guarantee an allergen-free environment. Cross-contact may occur during transportation, preparation, cooking, or service. Customers and guests with severe allergies should exercise their own judgment and caution.

Due to insurance, food safety, and pricing requirements, Hibachi2U does not cook outside proteins or customer-provided food unless expressly approved in writing by Hibachi2U.

7. Rain or Shine; No Refunds

Hibachi2U provides service rain or shine. Weather does not entitle the customer to a refund, credit, or chargeback. The customer is responsible for providing a safe, dry area for the chef to cook under in the event of rain or other weather.

All payments are non-refundable unless Hibachi2U expressly agrees otherwise in writing or a refund is required by applicable law. Our Refund Policy is incorporated into these Terms by reference.

8. Cancellations and Rescheduling

Cancellations and rescheduling requests are subject to Hibachi2U approval, availability, and applicable fees. Requests made within 48 hours of the event may be subject to a $200.00 fee or other charges, including costs related to food, staffing, travel, administrative work, or lost booking availability. A reschedule is not confirmed until Hibachi2U confirms it in writing or through its official booking system.

9. Arrival, Setup, and Event Timing

Chefs generally arrive shortly before the scheduled reservation time to set up. Service times, arrival windows, and event flow may vary due to traffic, weather, access issues, prior bookings, operational needs, or circumstances outside Hibachi2U’s control. The customer must ensure the event space is ready before the scheduled time.

10. Safety; Conduct; Right to Refuse Service

Customer and guest safety is a priority. The customer agrees to supervise guests, children, and pets and to keep them away from the cooking station, grill, hot surfaces, fuel, knives, food preparation areas, and chef equipment. The customer is responsible for the conduct of all guests.

Hibachi2U may refuse, pause, modify, or stop service without refund if any condition or conduct creates a safety risk, legal risk, health risk, harassment concern, intoxication concern, property access issue, threat, abusive conduct, or other unreasonable interference with the chef or service.

11. Customer Property and Event Location

The customer is responsible for the event location and customer-provided setup. Hibachi2U is not responsible for damage caused by unsuitable surfaces, unsafe setups, decorations, weather, guest conduct, pets, children, or conditions outside Hibachi2U’s reasonable control. Customers should protect surfaces, furniture, landscaping, and personal property as needed.

12. Photos, Videos, Reviews, and Promotions

If you submit, tag, post, upload, or share photos, videos, reviews, testimonials, or other content involving Hibachi2U, you grant Hibachi2U a non-exclusive, worldwide, royalty-free right to use, reproduce, display, edit, publish, share, and promote that content for website, social media, advertising, marketing, and business purposes, unless prohibited by law or agreed otherwise in writing.

13. Website Use

You agree not to misuse the website, interfere with its operation, attempt unauthorized access, submit false information, scrape content, upload harmful code, violate law, or use the website for fraudulent, abusive, or unlawful purposes. Hibachi2U may restrict or terminate access to the website or services if we believe these Terms have been violated.

14. Intellectual Property

The Hibachi2U name, website content, logos, photos, videos, text, graphics, design elements, menu descriptions, and related materials are owned by or licensed to Hibachi2U and are protected by intellectual property laws. You may not copy, reproduce, modify, distribute, display, or use our content for commercial purposes without written permission.

15. Third-Party Services

The website or booking process may include third-party links, maps, social media platforms, booking tools, payment processors, review platforms, or other services. Hibachi2U is not responsible for third-party websites, tools, terms, policies, security, availability, or content.

16. Disclaimers

The website and services are provided on an “as is” and “as available” basis to the maximum extent permitted by law. Hibachi2U does not guarantee that the website will be uninterrupted or error-free, that all information will be current at all times, or that every request, allergy accommodation, menu item, location, chef, or time slot will be available.

17. Limitation of Liability

To the maximum extent permitted by law, Hibachi2U and its owners, members, managers, employees, chefs, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, punitive, exemplary, or lost-profit damages arising out of or related to the website, booking, event, services, food, weather, customer setup, customer property, or these Terms. To the maximum extent permitted by law, Hibachi2U’s total liability for any claim will not exceed the amount paid by the customer for the specific event giving rise to the claim.

18. Indemnification

You agree to defend, indemnify, and hold harmless Hibachi2U and its owners, members, managers, employees, chefs, contractors, affiliates, and service providers from and against claims, damages, losses, liabilities, costs, and expenses arising out of or related to your booking, event, guests, property, location, breach of these Terms, violation of law, unsafe conditions, customer-provided items, or misuse of the website or services.

19. Governing Law and Dispute Resolution

These Terms are governed by the laws of the state where the applicable Hibachi2U service is booked or provided, without regard to conflict-of-law rules, unless another governing law is required by applicable law or agreed in writing. Any dispute must be brought in a court of competent jurisdiction unless the parties agree to another dispute resolution process in writing.

20. Changes to These Terms

Hibachi2U may update these Terms at any time. Updated Terms will be posted on the website with a revised effective date. The Terms in effect at the time of booking generally apply to that booking, unless a change is required by law or the parties agree otherwise in writing.
